Trademark Your Business Name

Many have asked about how to get a Trademark. Since I have one I thought I could chime in.
If you are going into to business it is was one expense you need to consider.

First make sure before you register your business name that no one else is using a name that is very close to yours. Google for it. Check the trademark office. Do your homework. If you choose a name too close to someone else’s name you could apply for trademark and pay the fees and lose (no refund). So be sure the name you want to use is not already being used by other people. Just become the .com you want is available does not mean the name is not being used and available.

Do not use a trademarked word in your business name or product (like Binky or Onsie). That can get you in big trouble.

File for your LLC free at http://mycorporation.com/mycorp-llc-package/
Then register your name with your state (approx $50) and get the .com website name to match ($10 a yr).
Create your website using the name you want to trademark. (host $10 a month)

Then file for your state trademark, usually pretty inexpensive and easy. $50 for Oregon http://smallbusiness.findlaw.com/trademark/trademark-registration/state-trademark-info-links.html

Then file for the Federal Trademark at
http://www.uspto.gov/trademarks/index.jsp
The fee starts at $400 and takes many months. The important thing is the pick the category for the types of products you will associate with your trademarked name. Be patient. They will come back and ask for more info along the line. Just keep working through the system.

This is very important if you want to protect the name you are using. If you do not do this and someone else decides to register that name or one close you could be asked to close your site or change your business name after using it for a while.

    Good article Kay! I trademarked my business name and the process took a year from start to finish. I have been pleased with the decision, since I put much effort into marketing my business name.
