CPSIA – Consumer Products Safety Improvement Act

Do you like to buy handcrafted children’s items? Many will disappear Feb 10, 2008.

New CPSIA (Consumer Products Safety Improvement Act) rules will require expensive redundant lead testing on all children product: books, clothes, toys, stationary, room decor, safety products etc. And this rule is retroactive to include products already made last year.

Small businesses and crafters will not be able to pay $100-4000 per item to be tested in order to keep selling. http://www.cpsc.gov/ABOUT/Cpsia/cpsia.HTML

This rule will affect products in schools, day care centers, libraries, Goodwill, resale stores, craftshows, garage sales, ebay and craigslist. It will be illegal to sell or distribute or store children’s product that contain over 600 ppm lead and those not tested.

They are calling Feb 10th national Bankruptcy day because of the number of small business that will be forced to close down. http://nationalbankruptcyday.com/

If we all make a few calls we can make a difference. Waxman’s office said this was not intended to cover small American businesses but it does. They said it was an unintended fall out of keeping kids safe from Chinese imports that came to the US with lead. However our American small business are the ones being hurt.

PLEASE HELP and do your part!

In the mean time if you are a business do not stop running your business. Both Waxman’s office and Rockefeller’s office told me over the phone that no fines will be coming any time soon for anyone. And when they do start enforcing this it will be the big companies first. They both expect changes and exemptions to come long before fines start being issued to anyone.

They both told me that if you are making and selling safe LEAD FREE items continue doing so. Get paperwork showing you looked at your components. Or get XRT test on first run. Or in some way show that you looked to make sure your products were safe. Then keep making and selling your safe products.

The CPSC past history shows they have rules to enforce and they do not have the man power or budget to enforce the ones they have now. They are looking only for the big blatant rule breakers that are hurting someone.

I have to beleive we have HOPE for change in CPSIA in the future. And I am doing my part to help fight for that change. How about you?

    The CPSIA confuses me lol they’re like my 3 year old without a nap…

    In theory, could I buy from a company like Michael Miller who has sent me documents saying their fabrics are lead free, and use a fiber fill that has stated that they are lead free, and continue to sell my blocks?
